Onboarding Terms Summary

This Onboarding Terms Summary is the first-login overview accepted by the authorised account administrator on behalf of the Customer organisation. It summarises key obligations and links to the full By5 legal documents for review.

The By5 platform is provided by By5 Ltd ("By5").

This summary should be read together with the Commercial Licence & Platform Terms, Privacy Policy, Data Processing Addendum, Cookies & Telemetry Notice and Subprocessor List.

Summary Points

  • By5 is provided on an agreed product and module-entitlement basis. The included foundation covers tenant settings, customer records and support surfaces; scoped subscriptions may add QUOTES, JOBS, COIN, COMMUNICATIONS or other expressly agreed modules.
  • COMMUNICATIONS or other agreed scopes may include managed capture workflows, communication channels, content support and provider setup under fair use when those services are part of the agreed enquiry workflow.
  • By5 uses third-party providers including Auth0, Twilio, Mailgun, AI providers, billing providers, hosting providers and infrastructure services.
  • By5 Ltd acts as controller for account administration, billing, onboarding, support, platform security and related service-management data.
  • By5 Ltd acts as processor for Customer-controlled enquiry, job, media, attachment and workflow data handled on the Customer's behalf through the platform.
  • By5 does not use identifiable or pseudonymised Customer-controlled data to train shared AI models.
  • After normal access ends, Customer-controlled data can be returned through an operator-assisted request for 30 days. Active application data is then deleted or anonymised by day 60, subject to narrow legal holds, and backup copies expire within 90 days.
  • Automated assistants must be disclosed as automated where appropriate, and customers must be able to request a human handover where reasonably practicable.
  • Heavy messaging, heavy storage, exceptional automation volume, extra channels, extra senders, deep integrations or custom delivery may require review, an add-on or a package upgrade.
  • The service is not for emergency, life-critical, safety-critical, medical, legal, financial or regulated communications where reliance on automated output may create risk of harm, loss or liability.

Acceptance Effect

  • Acceptance is recorded for the authorised Customer account administrator and the current legal documentation version.
  • If the legal documentation version changes later, an authorised Customer administrator may be asked to accept the newer version before normal use continues.
  • Continued use of the platform after notice of updated legal documents may constitute acceptance of those updated terms, unless otherwise agreed in writing.
